Man convicted of cruelty to a person has sentence increased

A man convicted of cruelty to a person, after assaulting a young family member, has had his sentence increased to three years in prison at Woolwich Crown Court.

His name is not being released in order to protect the identity of his victim.

On 22nd January 2021, the offender assaulted the victim for several hours in the family home, by hitting him with metal rods and a belt.

When the victim’s mother returned home, she took the victim to the hospital, where the matter was reported to the Police.
The offender had previously been sentenced to 22 months' imprisonment, suspended for 12 months, with a 2-month curfew order.

Peter Shergill, District Crown Prosecutor with the CPS, said: “The CPS’ ambition is to secure justice in every possible domestic abuse case. As the principal prosecution service for England and Wales, we want to make sure that all victims, irrespective of background or circumstance, see justice done.

The increase in sentence in this domestic abuse case, a case that we highlighted to the Attorney General to refer to the Court of Appeal, properly reflects the seriousness of the assault.

The original decision to suspend his sentence was unduly lenient as the appropriate punishment should have been an immediate custodial sentence.”
