The primary duty of the CPS is to deliver justice through the independent and effective prosecution of crime. The purpose of making a charging decision is to determine whether a suspect should be subject to criminal proceedings. The charging decision is the gateway to the criminal justice system with all the protections that the process affords.

The law limits the amount of time a person charged with a criminal offence can be kept in custody before the case is dealt with at court. This period (there are four different time limits depending on the type of offence and which court is dealing with the case) are called custody time limits. These limits must be strictly observed and can be extended by the court only in exceptional circumstances.

Custody Time Limits (CTL) safeguard unconvicted defendants by preventing them from being held in pre-trial custody for an excessive period of time. The Act and Regulations governing CTLs require the prosecution to progresses cases to trial diligently and expeditiously.

The provisions relating to the CBO are in Part 11, Chapter 1 of the Sentencing Act 2020 (the "Act"). The provisions came into force on 1 December 2020.

The Criminal Cases Review Commission (CCRC) has the power to investigate possible miscarriages of justice and refer appropriate cases to the Court of Appeal, on grounds of conviction, sentence or both. It also has similar powers to investigate and make references to the Crown Court in summary cases.

Investigation costs include obtaining sufficient evidence either at the initial stage or later at CPS request; re-interviewing witnesses; seeking medical or expert evidence as part of the investigation, (where a witness is required to attend Court, the cost of the attendance falls on the CPS).
