This guidance sets out considerations for Prosecutors and the Police following the coming into force of the Assaults on Emergency Workers (Offences) Act 2018 (“the 2018 Act”) on 13 November 2018.
Misconduct in public office is an offence at common law triable only on indictment. It carries a maximum sentence of life imprisonment. It is an offence confined to those who are public office holders and is committed when the office holder acts (or fails to act) in a way that constitutes a breach of the duties of that office.
The Code for Crown Prosecutors is a public document, issued by the Director of Public Prosecutions, that sets out the general principles Crown Prosecutors should follow when they make decisions on cases.
