This guidance is to assist prosecutors who will sometimes have to decide whether to charge an offence, or continue with a prosecution, where a nominal penalty is likely.
In 2017, the government introduced legislation that made it statutory for organisations with 250 or more employees to report annually on their gender pay gap.
