CPS decides to charge Joshua Kerry with preparing terrorist acts

The Crown Prosecution Service has decided to prosecute Joshua Kerry for engaging in conduct in preparation of acts of terrorism, including against Nigel Farage MP.

Kerry, 28, of Rotherham, will appear at Westminster Magistrates’ Court on Wednesday 7 October 2026.

Frank Ferguson, Chief Crown Prosecutor of the Crown Prosecution Service’s Special Crime and Counter Terrorism Division, said: “Having carefully reviewed the evidence we have made the decision to prosecute Joshua Kerry for engaging in conduct in preparation of terrorist acts.

“Our prosecutors have worked closely with police to establish that there is sufficient evidence to bring this case to court, and we will continue working with them as their investigation progresses.

“We remind all concerned that proceedings against Joshua Kerry remain active and he has the right to a fair trial.

“It is vital that there should be no reporting, commentary or sharing of information which could in any way prejudice these proceedings.”

  • Joshua Kerry (21/04/1998) of Byrley Road in Rotherham has been charged with one count of preparation of terrorist acts, contrary to section 5(1)(a) of the Terrorism Act 2006. He has previously been charged with one offence of murder.
  • The CPS’s Counter Terrorism Division authorised police to charge Kerry following an investigation overseen by Counter Terrorism Policing.
  • The function of the CPS is not to decide whether a person is guilty of a criminal offence, but to make fair, independent and objective assessments about whether it is appropriate to present charges for a criminal court to consider.
  • The CPS assessment of any case is not in any sense a finding of, or implication of, any guilt or criminal conduct. It is not a finding of fact, which can only be made by a court, but rather an assessment of what it might be possible to prove to a court, in accordance with the Code for Crown Prosecutors.
