Please could you provide me with the following…
Details of the number of cases submitted to you by Cumbria Police where the crimes were motivated by hate or were hate crimes.
- A breakdown of those cases in terms of the sort of offence (eg: assault, criminal damage, etc)
- Of those cases, the number where charges were brought and the number where they weren’t.
- For cases where charges weren’t brought, a breakdown of the reasons given (eg: insufficient evidence, too much time elapsed since the offence etc)
- For cases where charges were brought, a breakdown of the outcome of any trial (this could be summarised in terms of fines, custodial, suspended sentence etc)
Please could you provide me with the above for the years 2022, 2023 and 2024.

The Crown Prosecution Service (CPS) does hold some recorded information falling within the scope of your request.
Please find attached for your reference an excel spreadsheet labelled ‘13158 DATA’ and note the caveats appended to that data when considering the disclosure.
The data shows information concerning the Cumbria Police Force Area, for the calendar years 2022, 2023 and 2024, where a hate crime flag has been applied.
In the pre-charge tab of the data table, we have addressed points 1, 3 and 4 in your request, namely the overall number of referrals for early advice or a charging decision (cases submitted), number of charges and number of ‘no further action’ (NFA) outcomes.
For offence type (point 2), we have inferred that your request concerns the Principal Offence Category (POC). We are however unable to provide referrals broken down by POC but do have charges and NFAs by the Pre Charge POC, which are provided. We also have data on the reasons for NFAs, also included on the ‘Pre-Charge’ tab.
With regards to point 5 of your request, we also hold data on convictions and non-convictions and this data is again broken down by the Post Charge POC and included in the data set.
Finally, under section 16 of the Freedom of Information Act we have an obligation to advise what, if any information may assist you with your request. With regards to sentencing and case outcomes, the Ministry of Justice (MoJ) are the official statistics holders of sentences imposed by the courts and they publish defendant data by specific offence.
