This guidance describes why consents to prosecute are required and when they are necessary. It also identifies the timing of consents and their application.

This guidance deals with the legal and technical issues that arise when considering offences relating to drink/drug driving. The purpose of the guidance is to assist prosecutors with: selection of appropriate charges, including alternative offences for trial purposes, consideration of relevant statutory defences tools to address common defence challenges.

This guidance sets out considerations for Prosecutors and the Police following the coming into force of the Assaults on Emergency Workers (Offences) Act 2018 (“the 2018 Act”) on 13 November 2018.
