CPS North East - Domestic Abuse Prosecutions - July 2022

Below are some examples of domestic abuse cases successfully prosecuted by CPS North East in July 2022. 

The defendant was convicted of assault by beating after he grabbed his mother by the arm and pushed her, causing an injury. The case proceeded on the evidence of her 999 call and police accounts after she refused to support the prosecution. He was sentenced to a conditional discharge for six months. 

The defendant was convicted of breach of a restraining order. Despite an indefinite order prohibiting him from contacting his former partner, he inundated her with texts and phone calls. He was sentenced to twelve months’ imprisonment. 

The defendant was convicted of stalking, after he inundated his ex-partner with emails, Instagram messages and phone calls, and attended her address uninvited over a prolonged period of time. He was sentenced to a community order for twelve months, with rehabilitation activities and unpaid work. A restraining order was made for two years.

The defendant was convicted of assault causing actual bodily harm after a sustained assault on his partner left her with a black eye. He was sentenced to a community order for twelve months, with a curfew for five months and unpaid work requirement. He was ordered to pay compensation in the sum of £150. A restraining order was imposed for 18 months. 

The defendant was convicted of sending malicious communications after he sent threatening and offensive messages to his sister. He was sentenced to a community order for twelve months, with rehabilitation activities. 

The defendant was convicted of non-fatal intentional strangulation, under new non-fatal strangulation and suffocation legislation which was introduced in June 2022, after he forcefully held his partner by the neck, before forcing her to the floor where he kicked her. He was sentenced to 20 weeks’ imprisonment. A restraining order was imposed for three years.

The Defendant was convicted of non-fatal intentional strangulation, assault causing actual bodily harm and threatening with an offensive weapon after a sustained assault on his ex-partner, which included grabbing her in a head lock and dragging her to the floor before banging her head on the floor three times and punching her in the face. He also wrapped his arm around her neck and covered her mouth so she could not breathe, before finally threatening her with a knife. He was sentenced to 20 months’ imprisonment. A restraining order was imposed for a period of five years.

The defendant was convicted of assault by beating after he grabbed his ex-partner by the neck and punched her to the head. The victim retracted her support for the prosecution, but the case proceeded on other evidence and admissions in interview. The incident preceded the introduction of the new offence of non-fatal strangulation. He was sentenced to a fine of £120. 

The defendant was convicted of stalking after he sent his ex-partner more than 150 emails from three different accounts, some of which were abusive in nature and sent her similar messages via three different Facebook accounts. He was sentenced to a community order for 24 months, with rehabilitation activities and unpaid work and ordered to pay compensation in the sum of £150. A restraining order was imposed for twelve months.

The defendant was convicted of assault by beating after he was seen to hit his partner in the face with force. The victim did not support a prosecution, but the case proceeded on independent eyewitness testimony. His suspended sentence of twelve weeks, to which he was already subject, was activated and an additional four weeks’ imprisonment was added for this offence. A total of 16 weeks’ imprisonment followed.
