CPS North East -Domestic Abuse Prosecutions - August 2021
Below are some examples of Domestic Abuse cases successfully prosecuted by CPS North East in August 2021.
The Defendant was convicted of harassment towards her partner after she had persistently messaged and emailed him and made calls to his parents’ house against his will. She was sentenced to a fine of £120. A restraining order of twelve months was imposed.
The Defendant was convicted of stalking his partner after he bombarded her with social media messages and emails, confronted her in the street and attended her home on numerous occasions uninvited. He was sentenced to a twelve-month community order and fined £80. Compensation was ordered to be paid to the victim in the sum of £500 and a restraining order of three years was imposed.
The Defendant was convicted of stalking after he had persistently tried to contact his ex-partner by e mail, social media, attending her address and setting up fake profiles in the face of having been warned by police not to make contact. He was sentenced to a fine of £1500 and ordered to pay compensation in the sum of £200 to the victim. A restraining order was imposed for two years.
The Defendant was convicted of assault by beating after CCTV captured him pushing his wife in the street following an altercation. He was sentenced to a conditional discharge for three months and ordered to pay compensation to the victim in the sum of £150.
The Defendant was sentenced to 13 months’ imprisonment, suspended for two years, after he was convicted of causing grievous bodily harm to his partner. A sustained assault had resulted in a fractured rib and pneumothorax. He was ordered to complete a rehabilitation programme and do unpaid work. Compensation in the sum of £350 was ordered to be paid to the victim and a restraining order was imposed for ten years.
The Defendant was convicted after trial of assaulting his mother by poking her in the head and pushing her, he was also convicted of an assault towards his sister whom he grabbed by the throat and hair following a family altercation. He was sentenced to 16 weeks’ imprisonment, suspended for twelve months, with a rehabilitation activity requirement. Compensation in the sum of £150 was ordered to be paid to each victim. A restraining order was imposed for two years.
The Defendant was convicted of criminal damage and breach of a restraining order after he attended the address of his ex-partner and damaged her car. He was sentenced to 16 weeks’ custody and ordered to pay compensation to the victim of £800.
The Defendant was sentenced to immediate imprisonment for 26 weeks after he was convicted of assault by beating and obstruct PC. The case proceeded without the support of the victim, his partner, whom the court accepted he had punched repeatedly and caused injury to her arm and face. The case went ahead on other supporting evidence.
The Defendant was sentenced to eight weeks’ imprisonment suspended for 18 months after he was convicted of attending the address of his ex-partner on two occasions in breach of a restraining order. The case proceeded without the support of the victim who had retracted her complaint. He was required to complete a rehabilitation programme as part of his sentence.
The Defendant was convicted of threats to commit criminal damage against the property of his partner. The case proceeded without the support of the victim who refused to support the prosecution. The prosecution went ahead on other supporting evidence. He was sentenced to a fine of £300.
