Charging
This guidance is issued under section 37A of the Police and Criminal Evidence Act 1984. It is to enable custody officers to decide how a person should be dealt with when:
- tthe custody officer determines there is sufficient evidence to charge a person with an offence
- a person has been arrested for breach of bail who had previously been released on bail for a charging decision.
It also specifies what information must be sent to the prosecutor to enable a charging or other decision to be made.
It has applied since 3 April 2007 to investigations instigated by HM Revenue & Customs (HMRC).
