CPS Conditional Cautioning Data by Quarter

Description

Conditional cautions are an alternative to prosecution in court for some offences, where the person accused admits the offence. The aim of a conditional caution is to deal with the offence quickly, to deter people from repeating the offence, take action to repair the damage caused, rehabilitate the offender, and to prevent the courts from being overburdened.

The conditional cautioning data shows the number of times a conditional caution is issued on a quarterly basis, it includes information about location, type of conditions and what happens if conditional cautions are not complied with.

Since 8 April 2013, the police have been able to issue a Conditional Caution without reference to the CPS in all categories of offences except for indictable only offences and those categorised as hate crime or domestic violence. The decision to issue a Conditional Caution for any Indictable Only offence, must be taken by the CPS and only in exceptional circumstances.

After this date, the CPS data will only record those cases which must be referred to the CPS by the police; cases where following a request for Charging advice, the CPS determined that the case was more suitable to be dealt with by way of a Conditional Caution; and, those cases where the police have charged a suspect but a prosecutor on review following charge determines that it is more appropriate to proceed by way of a Conditional Caution.
