Appendix 12 - Intention to downgrade/dismiss
- I refer to the written warning (Appendix 3/5) you received on ......... and also to the Box 5 assessments in your last two appraisal reports and to the minute from your line manager dated ..... (Appendix 10)].
- The minute dated ...... warned you that if your performance did not meet the normal requirements of Level .../Level ... Pay Band ... [attendance did not reach a satisfactory level], consideration would be given to terminating your appointment.
- The monitoring of your performance/attendance since ........ shows that you have still not reached an acceptable level of performance/attendance and accordingly your case has been referred to me for consideration. I have to inform you that I do not regard your performance to be of the standard required of Level .../Level ... Pay Band.. [ your attendance to have reached a satisfactory level] and therefore you are to be downgraded to Level .../Level ... Pay Band .../dismissed, with/without/xx% compensation, on the grounds of inefficiency arising from your poor performance/unsatisfactory attendance. [Reasons should be provided for withholding compensation, in whole or part.]
- However, before this decision is put into effect, you have the right of appeal to ........ Any appeal, detailing the grounds on which it is based, should be submitted to him/her within 10 working days of receipt of this minute.
- You may be assisted in the appeal by a trade union representative or work colleague.
Intention to dismiss (long term sickness absence)
- I refer to the letter from ........ dated ........ (Appendix 9) which informed you that your papers had been referred to me with a recommendation that your employment be terminated.
- Your sickness absence record shows that you are unable to maintain a satisfactory level of attendance. I have to inform you that your continuing absence is no longer acceptable and accordingly you are to be dismissed, with compensation (the maximum payable in accordance with the Civil Service Compensation Scheme)/without compensation/with x% compensation, on the grounds of inefficiency arising from your unsatisfactory attendance.
- However, before this decision is put into effect, you have the right of appeal to ........ Any appeal, detailing the grounds on which it is based, should be submitted to him/her within 10 working days of receipt of this minute.
- You may be assisted in the appeal by a trade union representative or work colleague.
