Decision to Charge

Once the Police have completed their investigations, they will refer the case to the Crown Prosecution Service for advice on how to proceed. We will then make a decision on whether a suspect should be charged, and what that charge should be.

The Role of The Crown Prosecution Service

The Crown Prosecution Service is the government department responsible for prosecuting criminal cases investigated by the police in England and Wales.

As the principal prosecuting authority in England and Wales, we are responsible for:

  • advising the police on cases for possible prosecution
  • reviewing cases submitted by the police
  • determining any charges in more serious or complex cases
  • preparing cases for court
  • presenting cases at court

Police sergeant to face common assault charge

Malcolm McHaffie, Deputy Head of Special Crime at the Crown Prosecution Service, said: "The CPS received a file of evidence following an Independent Police Complaints Commission (IPCC) investigation into an arrest and detention of a 32-year-old man by Greater Manchester Police in the early hours of 15 July 2012.

"After carefully considering all the available evidence, we have advised the IPCC to obtain a summons in respect of Sergeant Richard Miller to face a charge of common assault contrary to section 39 of the Criminal Justice Act 1988.

"The decision to prosecute has been taken in accordance with the Code for Crown Prosecutors.

"Sergeant Miller will appear at Manchester Magistrates' Court on 8 February." 

The defendant now stands charged with a criminal offence and it is important that nothing is said, or reported, which could prejudice his right to a fair trial.
