Decision to Charge

Once the Police have completed their investigations, they will refer the case to the Crown Prosecution Service for advice on how to proceed. We will then make a decision on whether a suspect should be charged, and what that charge should be.

CPS advises no prosecution following death of teenager in custody

The Crown Prosecution Service has advised Northamptonshire Police there should be no prosecution over the death of Gareth Myatt, 15, who was an inmate at Rainsbrook Secure Training Centre, near Rugby.

Reviewing lawyer Withiel Cole said: "This was a tragic death of a young man while in the custody of the state and I have taken the greatest care to review the evidence to see if anyone should be prosecuted.

"Gareth's family have been informed of the progress of the case and evidence was sent to their pathologist for comment. A response from the family's solicitors was received at the end of last month.

"I have considered extensive medical advice on what caused Gareth's death as well as comprehensive advice from counsel and have decided there is insufficient evidence for a realistic prospect of conviction against any individual or organisation.

"I extend my sympathies to Gareth's family on their loss and have told them I am willing to meet them to explain my decision."

An inquest will now be held into Gareth's death.

  1. Gareth Myatt died on April 19, 2004 after being restrained by staff at Rainsbrook. He was at the centre to serve a 12 month sentence for assault and theft.
