Sexual Offences

The Sexual Offences Act 2003 updated the law, much of which dated back to 1956.

The main provisions of the Act include the following:

  • Rape is widened to include oral penetration
  • Significant changes to the issue of consent
  • Specific offences relating to children under 13, 16 and 18
  • Offences to protect vulnerable persons with a mental disorder
  • Other miscellaneous offences
  • Strengthening the notification requirements and providing new civil preventative orders

The Role of The Crown Prosecution Service

The Crown Prosecution Service is the government department responsible for prosecuting criminal cases investigated by the police in England and Wales.

As the principal prosecuting authority in England and Wales, we are responsible for:

  • advising the police on cases for possible prosecution
  • reviewing cases submitted by the police
  • determining any charges in more serious or complex cases
  • preparing cases for court
  • presenting cases at court

CPS Statement: Barry Bennell

A CPS spokesperson said: "Today, 9 May, former professional football coach Barry Bennell, 63, was informed that he has been charged with 21 counts of non-recent sexual assault on boys aged between 14 and 16 years of age. These are 18 counts of indecent assault, two counts of buggery and one count of attempted buggery.

"He will appear via video link at South Cheshire Magistrates' Court on the afternoon of Wednesday, 17 May in relation to these charges.

"The Crown Prosecution Service reminds all concerned that criminal proceedings against Mr Bennell are live and that he has a right to a fair trial. It is extremely important that there should be no reporting, commentary or sharing of information online which could in any way prejudice ongoing proceedings."

SUMMARY OF CHARGES:

In total Mr Bennell has been charged with 41 offences relating to eight male complainants. The date range covered by the charges is 1980 to 1991. He is next due to appear at Chester Crown Court on 3 July in relation to the charges listed below.

On 9 March Mr Bennell was informed that he has been charged with four counts of indecent assault on a boy aged 11 to 12 years.

  • The charges relate to one complainant
  • The alleged offences took place between 1981 and 1982

On 7 March Mr Bennell was informed that he has been charged with eight counts of non-recent child sexual abuse.

  • The charges are:
    • Five counts of buggery with a boy aged under 16
    • Two counts of indecent assault on a boy aged under 14
    • Indecent assault on a boy aged under 16
  • The charges relate to two complainants
  • The alleged offences took place between 1980 and 1987

On 27 September 2016, the Crown Prosecution Service received a file of evidence from Cheshire Police relating to allegations of non-recent child sexual abuse. Following a review of the evidence, in accordance with the Code for Crown Prosecutors, Mr Bennell was charged on 29 November with eight offences.

The charges are:

  • Three counts of indecent assault - boy under 13;
  • Three counts of indecent assault - boy under 16;
  • Attempted buggery - boy under 16;
  • Indecent Assault - boy under 16 (alternative count to attempted buggery).
  • The alleged offences took place between 1981 and 1985 and relate to one complainant
